General Terms and Booking Conditions
§1 Agency / Rental Contract Agreement
"Toscana Forum" is a private venture belonging to the company: Elisa Santoni Gabrielides, Internet-Travel, referred to from hereon as agent/agency. "Toscana Forum" arranges and negotiates holiday accommodation and acts on behalf of local lessors as an agent between the lessor and the hirer in a reservation and contract arrangement. The seasonal prices apply as published on the official website www.toscana-forum.com. The accommodation is arranged for the hirer at these specified prices and without further or additional commission charges. A rental agreement is drawn up between the customer, hereon referred to as the hirer, and the lessor for the period of time specified at the time of booking and is binding once the signed rental agreement has been received and confirmed in writing by Toscana Forum, hereby acting as agent (see also §2 Reservations, Confirmation). The total number of persons staying at the property may not exceed the number of persons specified in the rental agreement, children included. Additional persons may be refused or charged extra by the lessor. The occupants are responsible for the care and maintenance of the property during their stay and will be liable to reimburse the lessor for the full cost of any damage caused to the property or to any of the furniture, implements or other materials contained in it. It is their duty to report any breakages, defects or damage immediately. The occupants are also to be aware of and follow any house rules. Pets are not to be taken along unless stated in writing in the rental contract agreement.
§2 Reservations, Confirmation
Noncommittal enquiries regarding availability can be made either in writing, by phone or by sending a fax or email. Once Toscana Forum has received the reservation request (booking confirmation agreement) from the customer with the specific details and dates (per fax/email/post), this then becomes a binding agreement between the customer, hereon referred to as the hirer, and the lessor and the reservation becomes secured. Toscana Forum will then provide a rental contract agreement on behalf of the lessor. The reservation will become definitely binding once this agreement, containing the general terms and conditions, has been fully completed and signed by the hirer and returned to Toscana Forum by fax/post, together with a copy of the bank transaction form for the full confirmatory payment amount transferred to the agency. Once the confirmatory payment has been received by Toscana Forum the hirer will then receive confirmation of his booking along with a signed copy of the rental agreement and location details with directions for the property (per mail, fax, post). Should the full confirmatory payment not have been received by Toscana Forum within the deadline (within 8 days from the date shown on page 1 of the rental agreement), Toscana Forum is authorized by the lessor to cancel the reservation after a single reminder fails to elicit a response. Cancellation charges will then be applicable as detailed in §9 of the general terms and conditions and "Toscana Forum" has the authority from the lessor to collect. The balance payment is usually to be paid locally to the lessor on arrival.
§3 Forms of Payment, Supplements, Travel Documents
Having completed and returned the rental contract agreement to Toscana Forum the specified confirmatory payment (see page 1 of the rental agreement) is to be paid to the bank account detailed in §5 (see also §2 Reservations, Confirmation, and §5 Bank details). The balance payment is then to be paid either directly to the lessor on arrival (case 1) or in some cases to the agency account detailed in §5 not later than 30 days prior to arrival (case 2). Exact details will be specified on the first page of this rental contract agreement. Toscana Forum does not provide separate notification or receipt of payment. The hirer's bank payment slip is proof of payment. Please refer to the current price tables available on the internet site for a list of all facilities and incidentals which are included in the total price and for details of any supplements, services and facilities (e.g. extra bed, heating) which are charged extra.
These surcharges can be paid either to Toscana Forum or directly to the lessor.
§4 Provision of Services
Any additional services or requested facilities specified and arranged at the time of booking will be included in the reservation and in the total price.
Any additional expenses incurred or services arranged by the hirer on site during his stay (i.e. telephone, heating, utilities and personal services -maids/cooks) are to be paid by the hirer directly to the lessor locally in cash and before returning the keys.

Payments can be made through the bank or online, using online banking (through use of European or international transfers).
Should any charges or fees be incurred for such transfers, these will be paid for by the hirer.
Do not forget to state clearly the property name and reference code on the transaction form so that Toscana Forum knows which invoice/bill has been paid.
§6 Documents
On arrival the hirer and the occupants will be asked to show their passports or identification documents
§7 Security Deposit
A security deposit is usually required by the lessor on arrival to cover accidental damage or breakage. The amount differs for each property (see the first page of this rental agreement) and is payable on arrival and refundable on departure after inspection. The occupants are responsible for ensuring that the property is left in a reasonable condition of cleanliness. Any excessive cleaning, loss or damage to the property, or debts or charges incurred, will be itemized and charged to the hirer and deducted from the security deposit. Should the security deposit not cover the cost of the damages, the remaining sum is to be paid in cash before departure.
Occupants are required to act in a responsible manner at all times, and to act with respect towards other guests, neighbours, the lessor and their staff. Toscana Forum reserves the absolute right to require any individual to vacate a property for disruptive behaviour, in which case there will be no refund of any rental payment.
§8 Arrival, Departure Times
Unless otherwise agreed, all accommodation is available from 16-20:00pm on the arrival day and should be vacated by 10:00am on the day of departure. The lessor is to be informed of any earlier or later arrivals and the keys are to be returned and the lessor notified before departure.
§9 Cancellations, Rebooking, Holiday Insurance
Adequate and appropriate travel insurance is essential for the hirer's protection. If it becomes necessary for the hirer to cancel the reservation once it has been confirmed, the hirer must without delay inform Toscana Forum in writing (fax or by post). The following cancellation charges will apply, expressed as a percentage of the confirmatory payment and of the balance payment which are specified in the rental agreement, and are calculated from the date of the written notification of the cancellation. If the reason for the cancellation is covered by the hirer's travel insurance, he should be able to claim on it.

In some cases the lessor will accept a substitute tenant as opposed to a cancellation.
For any alterations or changes to a booking an extra 20 EUR will be charged.
§10 Website accuracy and Information
Toscana Forum has made every effort to ensure the accuracy of the information contained on its website at the time of publishing.
Some information and details have been based on information received from lessors, tourist offices etc, thus some aspects may change and
differ for which Toscana Forum cannot be held responsible. Toscana Forum and the lessor shall not be liable or otherwise accept responsibility
if, as a result of circumstances beyond their control, they have to change the hirer's holiday or cancel his reservation. Such circumstances
mean any event that Toscana Forum and the lessor could not foresee or avoid, even after taking all reasonable care, e.g: war, terrorist activity,
civil unrest, industrial disputes and strikes, bad weather and significant building work. In such a case where the property is no longer available
Toscana Forum or the lessor will make every effort to provide a similar property/accommodation. In such a case where Toscana Forum reserves the right to cancel
the reservation all monies paid will be refunded. The transfer of these payments to a third party, including marital partner or family members, is excluded.
§11 Complaints
In case of a problem or a complaint regarding the property the hirer must notify the lessor immediately (within 24 hours). As rental contract partner he is responsible. The hirer should also inform Toscana Forum in Munich of the problem within 48 hours if the problem has not been resolved by the lessor. The hirer should allow the lessor reasonable time to remedy the problem or to find suitable replacement accommodation. Vacating the property without Toscana Forum's authorization does not constitute an adequate cause for a refund. The hirer is responsible for informing Toscana Forum of any complaint and allowing reasonable opportunity to resolve the problem during the rental period. Failure to do so will avoid any claim following the rental period. Any dispute arising shall be subject to the exclusive jurisdiction of a competent court of law in Munich, Germany.
Booking a property in a foreign country it is with the understanding that there are cultural, architectural, economical and natural differences from the own country.
§12 Amendments
It is not permitted to amend or supplement this contract unless explicitly requested and accepted by Toscana Forum.
§13 Severability Clause
Should certain provisions in this contract become partly or entirely invalid or a breach or gap in the contract be found, so the remaining terms and conditions will be hereby unaffected and remain contractual.
To replace the ineffective clauses, provisions will be made which meet the intention of which is as close as possible to what the contract partners would have wanted on conclusion of this contract.
